Eight men and several Spinka charities charged with tax fraud in Los Angeles

Eight men and five Brookyln-based Spinka charitable organizations have been charged with tax fraud and money laundering. Six have been arrested, and two are still at large.

The men charged are Naftali Tzi Weisz, 59, a Grand Rabbi from Brooklyn; Gabbai Moseh E. Zigelman, 60, also from Brooklyn and Weisz’ assistant; Yaacov Zeivald, 43, of Valley Village; Yosef Nachum Naiman, 55, of Los Angeles; Alan Jay Friedman, 43, of Los Angeles; Joseph Roth, 66, an international accounts manager at a bank in Israel from Tel Aviv; diamond merchant Moshe Arie Lazar, 60; and Jacob Ivan Kantor, 71, an attorney from Tel Aviv. The first six were arrested last Wednesday, and four of them have been released on bail. The FBI believes Lazar to be in Israel. Kantor is also believed to be in Israel according to other reports.

The charitiable organizations named as defendants in the charges are Yeshiva Imrei Yosef, Yeshivath Spinka, Central Rabbinical Seminary, Machne Sva Rotzohn, and Mesivta Imrei Yosef Spinka. The FBI alleges that these charities issued fraudulent receipts for bogus charitable contributions and were the beneficiaries of fees charged for transfers of funds as part of a money laundering conspiracy.

By a 37-count grand jury indictment that was unsealed on Wednesday morning, Weisz and Zigelman are charged with one count of conspiracy to defraud the Internal Revenue Service and other crimes, 19 counts of mail fraud, one money laundering conspiracy count, 11 counts of international money laundering, and one count of operating an illegal money remitting business. Zigelman is in addition charged with two counts of aiding in the preparation of fraudulent income tax returns. Zeivald, Lazar, Naiman, and Friedman are charged in the main conspiracy count and with operating an illegal money remitting business. Zeivald is in addition charged with one count of mail fraud. Roth is charged in both conspiracy counts; several mail fraud counts; and several international money laundering counts. Kantor is charged in both of the conspiracy counts and several international money laundering counts.

The charges laid are that over a period of 10 years the conspirators solicited USD8.7 million in contributions to these charitable organizations, promising to secretly refund to the donors up to 95%, allowing the donors to claim the full amounts of the donations as tax deductions on their federal income tax returns. According to the FBI, this was done in two ways: Some donors received cash payments through an underground money transfer network involving Zeivald, Naiman, Friedman, and Lazar, some of whom operated businesses in and around the Los Angeles jewelry district. Other donors were reimbursed via loans made from the United States branch of an Israeli bank, organized by Roth and Kantor and secured on funds secretly held in that bank in Israel, to which the donations had been sent via wire transfer.

Several of the Brooklyn charitable organizations are schools. One such is Yeshiva Imrei Yosef, a private Orthodox Jewish school for boys in grades PK–12 with 312 students, which is one of 5000 such organizations approved for charitable donations by the Jewish Community Endowment Fund of the Jewish Community Federation of San Francisco. The Jewish Journal of Greater Los Angeles draws a parallel between these charges and the creation of bogus schools in the case of New Square, quoting Jonathan Sarna, a professor of American Jewish history at Brandeis University, as saying “I think that in Eastern Europe, especially where corruption was rampant, it was very common for Jews to engage in, shall we say, ‘extra-legal activities’ when they believed they were doing so not for their personal gain but for the good of the community or for some higher purpose.”

His observation is that defrauding a corrupt government is part of the culture that has sometimes been carried in to the United States, and that people justify it when they believe that the money is going towards Jewish education. “I think the idea is that Jewish education is so important and so expensive and the folks say to themselves, ‘we’re forced to pay for public education which we don’t use’, and they manage to sometimes justify in their own minds these kinds of activities that are for the sake of a holy end.”

Sarna states that violating the law is not condoned by Jewish communities in the U.S., a sentiment that has been echoed in reactions from the Los Angeles Jewish community, such as that by Rabbi Meyer H. May, president of the Rabbinical Council of California: “One thing is clear: The Orthodox community deplores any attempt to defraud the government of the United States, and there is no excuse for it, and there’s no rationalizations that are acceptable. […] It’s against the Torah and it’s against our moral foundation. At the same time, regarding these specific individuals, they should be allowed to have a fair trial, as everyone is innocent until proven guilty.”

The FBI’s press release contains a similar reminder of the presumption of innocence.

Calls by the New York Times were unable to obtain any comments on the case from the defendants.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

UK Serious Fraud Office to investigate MG Rover collapse

The United Kingdom’s Serious Fraud Office is to launch an investigation into the collapse of car manufacturer MG Rover. The move follows the conclusion of a four-year enquiry started immediately after the firm became insolvent.

The group of four who owned MG Rover — John Towers, Nick Stephenson, Peter Beale and John Edwards — have been accused of asset stripping. The quartet, known as the Phoenix Four, paid a symbolic £10 (approximately €15) for Rover in 2000. At that time the company received an interest-free loan from former owner BMW for £427 million (approximately €700 million) and came with a large amount of unsold stock.

Between then and Rover’s April 2005 bankruptcy, by which time there were unpaid debts of £1 billion (approximately €1.5 billion), the Phoenix Four had removed an estimated £40 million worth of assets including pensions and salaries. An enquiry was launched by ministers that was expected to take a year, but the final report was not delivered to business secretary Lord Mandelson until three weeks ago.

The government used taxpayer’s money to fund a £6 million loan to MG Rover and attempted to negotiate a deal with a Chinese company, but these efforts failed. MG Rover’s collapse caused the loss of an estimated 15,000 jobs, including with various suppliers. A former MG Rover factory does still build a small number of MG sports cars in Longbridge by Shanghai Automotive Industry Corporation, who bought most of the designs.

The Phoenix Four released a statement criticising the criminal investigation. “There has never been any suggestion of improper conduct by the directors and this was confirmed in a report by the administrators PWC six months after they took over the running of the company. Four years on, any suggestion [of] another further investigation is frankly ridiculous and smacks of kicking this issue into the long grass. If the government has been so concerned to get to the heart of the matter why has it flatly refused more than 30 requests under the Freedom of Information Act which would have revealed correspondence and documents the directors believe would have shed some light on the government’s role in the affair?”

This year’s Leisure Taiwan trade show (a.k.a Taiwan Sport Recreation and Leisure Show) started yesterday, with 131 companies participating including sports media companies such as ESPN and VideoLand Television, businesses selling sports equipment and fitness clubs.

There were also a variety of sports being played in the arena built for the trade show. The events included a 3-on-3 basketball tournament, free style shooting, and bicycle test-riding. In addition, conferences discussed issues related to sports and physical education.

A major topic in the trade show was energy-efficiency and, as a result, bicycles and similar sports equipment were being heavily promoted.

Next Tuesday, companies from the electronics industry plan to promote their industry at “2008 Digital E-Park.” In previous years, organizations from the electronics industry have showcased their products at Leisure Taiwan instead of at the Digital E-Park, so this move has reduced the number of markets covered by Leisure Taiwan.

The Polish Olympic Committee (PKOL) announced today the list of 258 sportsmen drafted to represent Poland at the 2008 Summer Olympic Games in Beijing, China. The number of olympians may increase by 10, as the Committee has given a number of athletes a final chance to qualify, including Lidia Chojecka and Ma?gorzata Tryba?ska. There are 101 women and 157 men on the team.

The 28-year-old canoer Marek Twardowski has been chosen for the national flag bearer. “There was, of course, a discussion. We rejected the candidacy of Otylia J?drzejczak, because she starts her Olympics on August 9, the same situation was with Leszek Blanik. They have answered that politics is not interesting for them in Beijing. They are concentrating on sports.”

It will be the third biggest Polish Olympic team in history; there were more sportsmen at the Olympics in 1972 (Munich, 288) and 1980 (Moscow, 321). Fours years ago the team numbered 202 sportsmen.

The players on the men’s and women’s volleyball teams, as well as the men’s handball team are still not known. The teams’ coaches Raul Lozano, Marco Bonitta and Bogdan Wenta have until July 19 to announce their rosters.

Overall, the team, including the medical staff, coaches, psychologists and others, will number over 400 people.

Thailand forces registration of prepaid phones to thwart insurgency

In a move aimed at hampering the near-daily bombing attacks in southern Thailand, all owners of prepaid phones are required to register by midnight local time today or face being blocked.

Originally scheduled for implementation at the end of last year, the move was deferred to allow people more time to register their phones. The policy only applies to the three southernmost provinces that border MalaysiaPattani, Narathiwat, and Yala — formerly the Malay Pattani kingdom.

Thais from other parts of the country with prepaid phones will also be required to register should they wish to visit the region. When doing so their calls will be treated as roaming, a feature of GSM which allows a user to make and receive calls on a network other than that of their service provider.

Many of the bombs used in the south are believed to be detonated by mobile phone, although most of the more than one thousand casualties in the region have been from drive-by shootings and stabbings.

It is reported that 65% of the near half-million prepaid phones in the region that this would impact have been registered. Prepaid phones are commonplace throughout Thailand and estimates put the number in use throughout the whole country at approximately ten million.

Other efforts to deal with the insurgency in the predominantly Muslim area include an announcement yesterday that approximately 20,000 local villagers will be given training and small arms to help defend their villages. Both men and women will be eligible, and those accepted into the programme will be put onto the government payroll.

Metal press crushes Illinois worker

A resident of Schaumburg, Illinois in the U.S. was severely injured by an industrial punch press machine on Monday. He died an hour later.

Elk Grove Village police said William Naras, 48, was operating the machine at a local metal manufacturing plant when he became pinned by an I-beam, or metal arm, about 4 p.m. He was transported to Alexian Brothers Medical Center in Elk Grove Village where medics pronounced him dead at 4:51 p.m.

The death was ruled an industrial accident and reported to the U.S. Occupational Safety and Health Administration, according to a spokesperson for the Cook County medical examiner’s office.

Presses of the type which killed Naras routinely develop pressures in the 80,000 pounds (40 tons) per square inch range, according to manufacturers’ Internet pages.
