Buffalo, New York —In an unanimous vote, the City of Buffalo‘s Planning Board voted to table the Elmwood Village hotel Proposal, postponing voting on legislation for up to 30 days.

The Board said its decision was due to the lack of public involvement, saying that there have not been enough meetings.

The Elmwood Village Hotel is a proposed project by Savarino Construction Services Corporation and was designed by Karl Frizlen of The Frizlen Group. The hotel would be placed on Elmwood and Forest Avenues in Buffalo, New York. In order for the hotel to be built, at least five buildings, that include both businesses and residents, must be demolished.

The Forever Elmwood Corp. is a Buffalo-based non-profit organization founded in 1994. Justin Azzarella, the Executive Director for the organization voiced support for the proposal, stating: “I am here today to lend Forever Elmwood’s support the hotel project. Particularly, Forever Elmwood is encouraged by the fact that this building follows the more stringent Elmwood Village Design Guidelines. We have been speaking with Savarino Construction, and they have promised us [Forever Elmwood] that they will engage the community further, including the surrounding Block Clubs and businesses. For that reason, while Forever Elmwood is in support of this project and the type of project that it is, we are asking also that the project be tabled so that the community can be further engaged. Specifically the surrounding Block clubs which include the Granger, Claremont, Asland and The Lincoln Parkway Block Clubs.”

“Because of the excellent work that Karl does and the game plan that they have, I think its an ideal use of this particular location. I think that this particular type of development needs to be encouraged and promoted as opposed to roadblocked,” said a man who owns five properties near the proposal site.

However, Evelyn Bencinich, a resident of Granger Place and whose house would be located directly behind the hotel said, “My property value will be depreciated or non-existent because no one is going to want to live behind a multi-story hotel. We are facing up to a year of noisy and dangerous demolition and construction. Children, pets and even drunk rebellers could wander on site and get hurt. Traffic tie-ups caused by large machinery and garbage bins is inevitable. Where will pedestrians walk? We could experience increased unsanitary flooding in our yards and basements due to the digging and cementing for the underground parking garage. Rats will be displaced into the immediate neighborhoods and be in great abundance. Once we get past the year of nightmare construction, what if you build it and they don’t come? We could ultimately have a seven million dollar rooming house on our corner.”

Patty Morris, co-owner of Don Apparel with Nancy Pollina at 1119 Elmwood also asked that the project be tabled saying, “this has only been public knowledge for less than two weeks and the public never saw the redesign. How can you vote on anything that no one has seen yet? The Board cut off Morris saying, “so specifically you don’t have any problem with it [the design] you just…” Morris then said, “Oh I am totally against this project, but thats besides the point isn’t it.”

The planning board is also concerned that the current design may still be too big.

At one point Board member Susan Curran Hoyt said, “we know you’ve cut down your number of rooms on this project, but we still see it doesn’t seem to fit the description of a ‘botique’ hotel,” and asked Eva Hassett, Vice President of Savarino Construction, “we wonder if you could reduce the rooms further.”

“One thing I didn’t talk about was the price levels of these rooms and that will be important to know. The room rate will be somewhere between US$120 and $160 a night, which is about the same price of the Hampton Inn down town and the smaller you make the hotel, the more expensive the rooms will get. We believe that we’ve made a good compromise in terms of the size of the hotel and perhaps botique means different things to different people,” said Hassett.

The board was also concerned that there is not enough parking asking, “are there alternative plans for valet parking off-site, in the event that you have a full hotel or a large event going on?”

“We are exploring several possibilities with respect to additional parking for valet and parking near-by,” replied Hassett. “We are also exploring the possibility of using the rear of 1105 Elmwood for additional parking, which would give us an additional ten or eleven spaces.”

The new design has a total of 55 parking spaces for 72 rooms, with 39 of them underground and the rest on ground level.

Hassett also said that a “parking study” will be done on the area.

Concerns that the second floor of the hotel will be too close to the property of 605 Forest were also brought up. The board asked how far the hotel would be from the property and Karl Frizlen replied saying it would “be approximately five feet from the property line,” but he also admitted that, “I do not know exactly how close the house next door” will be from the hotel, but did say “I think the house is about four or five feet away from the property line and we [the hotel] sit right on the property line.”

The board is concerned the setback from the property is not enough saying the space between the building and the hotel is “pretty narrow.”

The City’s Common Council also agreed to table the proposal also citing the need for more public engagement and the need for more organizations to respond including the Buffalo Preservation Board and the Office of Historic Preservation.

During that meeting, Hassett also said the proposal to try and get a variance to obtain the properties of 605 and 607 Forest were “now off the agenda.”

The Common Council is expected to meet and hold a public hearing about the project and the rezoning of the properties to be demolished (1119-1121 Elmwood) on Tuesday March 7, 2006 at 2:00 p.m. in Council Chambers at City Hall. At the moment the properties are not zoned for a hotel.

Fire kills three and closes main transport route into Western Australia

A fire in the Borrabbin National Park between Southern Cross and Coolgardie Western Australia, has so far burnt out 29,000 hectares and killed three truck drivers when the convoy they were travelling in was engulfed by the flames. Great Eastern Highway the primary road for all traffic from Perth heading to the East Coast of Australia has been closed. An alternate route is in place, police are diverting traffic at Norseman. The diversion adds 250 km(160 mi) for the journey to Perth.

The three truck drivers died on Sunday night after they joined a convoy that was released from Coolgardie after being told that the road was safe. Kieran McNamara director general of the Department of Environment and Conservation(DEC) admitted that it had been caught out by its decision to reopen the road at 8pm (wst) on 30 December.

Mr McNamara said “The decision was made with the advice from people at the firefront, and with the latest weather forecasts, and was judged to be the right decision and the safe decision at the time and in those circumstances… Regrettably and with hindsight, that’s not how it’s turned out.”

The driver of another truck in the convoy that was destroyed escaped with burns to his hands and was rushed through the fire front by firefighters to Yellowdine, another driver was rescued uninjured and return to Coolgardie, a spokesman for Whiteline transport the owners of this truck were thankful their driver survived unharmed saying the cost of the vehicle lost was about AU$400,000 plus cargo. Police confirmed that four trucks were destroyed by the fire.

Fire and Emergency Services Authority of Western Australia reported that they were fighting the fire without using water. All efforts were focused on building fire breaks with heavy machinery to contain the fire, that 90 volunteer fire fighters on the scene were there to defend the bulldozers.

The fire is still burning on a 150 km (90 mi) front, DEC spokesman says fire fighters are hoping to bring the fire under control with an expected cool change on Wednesday. The Weather Bureau has forecast temperatures to return above 40°C(105°F) by Thursday.

Local Police say that Great Eastern Highway will remain closed until the fire is under control and the damaged vehicles have been removed from the scene, at this stage its not expected to occur before Sunday.

US Air Force upgrades F-22 oxygen system after deadly crash

The United States Air Force is replacing emergency oxygen handles on its 170 F-22 Raptor jet fighters. The move follows a report into a November 2010 crash that killed a pilot in Alaska.

The report finds Captain Jeffrey Haney’s death was partly due to aircraft design flaws. The experienced 31-year-old was on a night mission when his aircraft crashed nose-down among mountains. Planemaker Lockheed Martin now faces legal action from his widow Anna, which they vow to contest.

The report identified three separate problems with the ring handle to activate emergency oxygen. The first was that pulling the ring could require intense effort, the second that it was possible to drop the ring between seats, and the third that pilots in cold-weather gear could struggle to grasp it.

Now new handles have been designed in Arizona and the Air Force will place them on all of the $143 million aircraft. All 40 Raptors at Haney’s base, Joint Base Elmendorf-Richardson near Anchorage, have received the $47 upgrade. The Air Force bought 200 of them.

Haney’s death has been attributed by his employer as the result of his “channelized attention” on getting the main oxygen system to restart after it automatically cut out when it detected engine bay air leaks. This makes breathing through the jet’s mask difficult. The Air Force say he should have activated his emergency oxygen but the accident report and lawsuit question his ability to do so. The report notes he was conscious and fighting to keep his jet airbourne up until impact.

Documents filed with a court in Illinois claim the handle’s position is “in an area impossible for a pilot to reach while he or she maneuvered the sophisticated aircraft at speeds exceeding the speed of sound and while he or she experienced forces many times the force of gravity.”

The fatal accident is not the only such problem to beset the F-22, which despite being billed by the Air Force as their most advanced fighter has never been deployed to combat since coming into service seven years ago. Three other Joint Base Elmendorf-Richardson pilots activated emergency oxygen supplies during “physiological incidents” last month, said a spokesperson for the base. Raptors were grounded nationwide for five months last Summer over the oxygen systems.

Iran to conduct missile defense exercise

The Iranian government has announced that the nation will be participating in a missile defense test which could take place as early as tomorrow.

According to the IRNA, Iran’s official news agency, the test is an annual exercise aimed to “maintain and develop” defense capabilities of the Iranian Revolutionary Guard.

The exercise is named ‘Great Prophet 4’ and will involve shooting a variety of live missiles at targets. Reports say the drill will be conducted in several unknown locations and will last for several days. The exercise also falls on the Jewish holiday of Yom Kippur.

The announcement comes just hours after the Iranian government stated that the nation was building a second nuclear power facility. The announcement was made in a September 21 letter from the Iranian government to the United Nations Security Council that a second nuclear plant was being constructed in the city of Qom.

ACTA rejected by European Parliament; protesters rejoice

The proposed Anti-Counterfeiting Trade Agreement (ACTA) was defeated in a plenary session of the European Parliament with 478 votes against versus 39 supporting; 165 parliamentarians chose to abstain.

Pressure and activist groups across Europe celebrated the defeat of the legislation, attributing their success to mobilising the public to bring pressure to bear on MEPs. In thanking supporters, the UK’s Open Rights Group (ORG) cautioned that Karel de Gucht, current European Commissioner for Trade, deferred any decision as to how the Commission will move forward until after a ruling from the European Court of Justice on ACTA’s compatibility with European law.

The controversial copyright- and trademark-related trade agreement previously provoked massive rallies and demonstrations across Europe. A petition against ACTA accrued two million signatures. In an editorial on the resounding defeat, where MEPs held up placards post-vote which read “Hello Democracy Goodbye ACTA”, The Guardian’s technology editor Charles Arthur said the agreement “didn’t stand a chance”. Arthur pointed out that some of the counterfeiting problems ACTA was, in part, supposed to address are ones which should concern people, particularly the risks associated with fake drugs. However, with the vague wording of the trade agreement raising the possibility of travellers’ electronic devices being searched for copyright-infringing content at customs and border checkpoints, he concluded the secretly-negotiated deal “never stood a chance against the internet tidal wave” of opposition.

Arthur also highlighted that secrecy surrounding the drafting of ACTA encouraged widespread public opposition; negotiations began under the presidency of George W. Bush, which rebuffed requests from the Electronic Frontier Foundation stating that all but ten of 800+ pages of related material were “classified in the interest of national security”. Following Barack Obama taking office, another Freedom of Information request was filed; again, access was denied with the Obama administration asserting that national security concerns justified the entire draft and related documents remaining secret.

Protesters criticised the vague wording and legal uncertainty ACTA would have introduced. Widespread censorship of the internet and curtailment of freedom of speech were feared; patent regulations were highlighted as having potentially adverse impact on access to medicines and crop seeds. The trade agreement, which US-based pressure group Accessnow.org described as “giving the U.S. a structural competitive advantage over other countries”, had already amongst its signatories Australia, Canada, Japan, Morocco, New Zealand, Singapore, South Korea, and the United States.

The long-running campaign against ACTA can in part be traced to publication of a leaked draft of the agreement on whistleblowing site Wikileaks. Their analysis concluded one part of the document was “a ‘Pirate Bay killer’?”, and the then-leaked draft would force internet service providers to provide “perfunctionary[sic] disclosure of customer information” and would “likely outlaw multi-region CD/DVD players.”

Man disguised as Darth Vader robs bank

A man dressed as the Star Wars antagonist Darth Vader robbed a bank in Setauket, New York. The robber was dressed in a character themed mask and blue cape. Armed with a hand gun, the robber stole an undetermined amount of cash from the Chase bank branch.

The robber entered the bank saying that he was robbing it. Customers initially thought it was a joke and began laughing. Detective William Lamb of the Suffolk County Police Department said that one customer attempted to tackle the robber and was attacked. He can be seen in the background of surveillance photographs. The robber then approached a teller and demanded cash while brandishing a weapon.

This robbery is the latest in a string of odd bank robberies in the New York metropolitan area. Yesterday the New York Police Department arrested a man who robbed banks while carrying flowers and potted plants. Police are also looking for an apparent cross-dressing robber who held up a bank in Long Island.
